AR This Clarification Text has been prepared by Sidamed Medikal Sağlık Hizmetleri Tic. Ltd. Şti. (“Data Controller”) in order to inform you, our patients, about the Personal Data Protection Law No. 6698 (“Law”) and your personal data obtained by the Data Controller, the purposes of processing your personal data, methods of collection and legal reasons, the transfer of your personal data, and your rights under the Law. In the event that a situation arises requiring the processing of your personal data not included in this Clarification Text, you will be informed separately, and your explicit consent for the processing of your personal data will be requested.
YOUR PERSONAL DATA
As the Data Controller, we process your personal data listed below within the framework of the processing purposes set forth in this Clarification Text:
- Your Identity Data: Name-surname, T.R. identity number, passport number, place and date of birth, gender, marital status.
- Your Contact Data: Address, phone number, e-mail address.
- Your Financial Data: Payment and billing information, financial details, private health insurance, and Social Security Institution (SGK) information.
- Your Health Data: Laboratory and imaging results, test and examination results, medical examination data, medications used, previous surgeries and treatment history, chronic diseases, prescription information, allergies, and health data contained within the patient file.
- Your Visual and Auditory Data: Photographs, videos, and other visual and auditory recordings.
- Next of Kin Data: Name-surname, T.R. identity number, address, and phone information of the patient’s relative to be contacted in necessary cases.
- Communication Data: Other data you share if you reach us via mail, telephone, fax, e-mail, and other channels.
- International Health Tourism Data: Flight information, boarding pass, tour itinerary, mile card number, accommodation data, visa information, passport photocopy/scan, passport number.
- Your Signature Data: Wet signature and e-signature data.
- Your Visual Records: Your data contained in security camera recordings.
PURPOSES OF PROCESSING YOUR PERSONAL DATA
Your personal data listed above is processed by the Data Controller within the scope of the following processing purposes:
- Fulfillment of our legal obligations set forth in the Health Services Basic Law No. 3359, the Decree Law No. 663 on the Organization and Duties of the Ministry of Health and its Affiliated Organizations, the Regulation on Private Health Institutions where Outpatient Diagnosis and Treatment is Performed, the Personal Data Protection Law No. 6698, the Regulation on the Processing of Personal Health Data and Ensuring Privacy, and other relevant legislation.
- Protection of public health, execution of preventive medicine, medical diagnosis, treatment, and care services.
- Planning and management of health services and their financing.
- Providing information regarding your appointment if you have scheduled one.
- Conducting analysis to improve our services.
- Invoicing and billing.
- Verification of your identity.
- Verification of your relationship with contracted institutions (Insurances, SGK, etc.).
- Responding to and providing information for requests from the Ministry of Health and other public institutions and organizations, and in necessary cases, law enforcement forces and judicial authorities in accordance with legal legislation.
- Responding to your questions or complaints regarding our services.
- Analyzing your use of health services for the purpose of developing the services we offer.
- In cases where your explicit informed consent is obtained before or after a procedure, sharing your visual recordings (photographs, videos) of medical procedures on domestic/international platforms, our website, and/or our social media accounts for the purpose of demonstrating the medical treatment process.
- Measuring and increasing patient satisfaction following the receipt of health services.
- Provision of medication, medical equipment, or medical devices.
- Informing you about new treatment methods.
- Planning and execution of corporate communication activities.
- Compliance with other information storage, reporting, and disclosure obligations prescribed by legislation, relevant regulatory agencies, and other authorities.
- Ensuring communication with patients and their relatives.
- Ensuring communication with relevant persons in case of emergencies.
METHOD AND LEGAL REASON FOR COLLECTING PERSONAL DATA AND STORAGE PERIOD
Your personal data included in this Clarification Text is collected through automatic or non-automatic methods; camera footage, telephone records, application forms, information you personally convey to us during examination, appointment, and treatment, tests and analyzes performed for treatment, laboratory and imaging results, and information received from public institutions and organizations for the realization of the processing purposes listed above.
Your personal data is processed based on the following legal reasons: your explicit consent for the purposes stated in this Clarification Text; in cases where explicit consent is not present, when it is clearly prescribed by law, when it is directly related to the establishment and performance of contracts, for the establishment, exercise, and protection of a right, when storage is mandatory for the legitimate interests of the Data Controller provided it does not harm your fundamental rights and freedoms, or when it is necessary for the fulfillment of legal obligations in accordance with relevant legal legislation; and for the protection of public health, preventive medicine, medical diagnosis, treatment and care services, and the planning and management of health services and financing.
Your personal data is stored for the duration of your treatment and for a period of 10 years from the date of the end of your treatment, taking into account the storage periods and the expiration of the statute of limitations periods specified in the relevant legal legislation.
TRANSFER OF YOUR PERSONAL DATA
By taking all necessary technical and administrative measures to ensure the appropriate level of security in accordance with the Law and relevant health legislation, your personal data listed in this Clarification Text may be transferred to private insurance companies, SGK, lawyers or law firms for the purpose of following up on legal affairs, financial advisors for the purpose of executing finance and accounting transactions, and domestic or foreign organizations/consultants/business partners/collaborators/suppliers with whom we have a contractual relationship and from whom we receive assistance/support/consultancy services to carry out our medical, financial, social media, and promotion, etc. activities, within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Law.
YOUR RIGHTS ACCORDING TO THE LAW AND APPLICATION TO THE DATA CONTROLLER
- In accordance with Article 11 of Law No. 6698, you have the right to:
- Learn whether personal data is processed,
- Request information if personal data has been processed,
- Learn the purpose of processing personal data and whether they are used in accordance with their purpose,
- Know the third parties to whom personal data is transferred domestically or abroad,
- Request correction of personal data if it is incomplete or incorrectly processed,
- Request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of Law No. 6698 and request notification of the transactions made in this scope to third parties to whom personal data has been transferred,
- Object to the occurrence of a result against the person himself by analyzing the processed data exclusively through automated systems,
- Request compensation for the damage in case of loss due to unlawful processing of personal data.
You can submit your applications regarding your rights listed above by filling out the “APPLICATION FORM TO THE DATA CONTROLLER IN ACCORDANCE WITH THE PERSONAL DATA PROTECTION LAW” available on our website at www.alidurmusobezite.com and within the body of the Data Controller, and:
- Deliver a signed copy in person to the address: 19 Mayıs mahallesi Büyükdere caddesi Tankaya Palas, D:No:14/2, 34360 Şişli/Istanbul, or send it via a notary public,
- Submit it to the address info@alidurmusobezite.com with a secure electronic or mobile signature, through your registered electronic mail address or your electronic mail address currently registered in our system.
